(“PROMOTIONAL OFFER”) TERMS AND CONDITIONS – AUSTRALIA

Information on how to enter the Promotion forms part of these Terms and Conditions. Customers who participate in this promotion agree to these Terms and Conditions.
The Promotion commences at 6:00 am AEST on 11th September 2023 and closes at 11.59 pm AEDST on 31st December 2023 (“Promotion Period”). Entries for the Promotional Period will be accepted online.
The Promoter is ITW Australia Pty Ltd (“Promoter”) of 157-185 Discovery Road, Dandenong South, Victoria 3175 Australia, ABN 63 004 235 063.
Employees (and their immediate families) of the promoter, resellers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
The Promoter collects personal information of Entrants in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.itwproline.com.au/privacy-policy/. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant and/or its authorised representative. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
Participation in the promotion is restricted to Australian residents aged 18 years and over. Entries are strictly available to individual consumers purchasing the outlined ITW brands directly from any store that forms part of Independent Hardware Group including Mitre 10, Home Timber & Hardware, Thrifty-Link Hardware and True Value Hardware. The promotion is not available in conjunction with commercial tenders or bulk orders. Resellers are not eligible to claim on behalf of 3rd party customers.
Any one individual may enter the competition as many times as desired during the promotion purchase period.
The Promoter reserves the right, at any time, to verify the validity of each entry and entrant. The Promoter reserves the right to disqualify any person for tampering with the promotional process. Further, any contact details provided incorrectly over the Internet or telephone may be deemed by the Promoter as an invalid entry. Errors or omissions will be accepted by the Promoter in its absolute discretion.
To enter the Promotion, a customer must, during the Promotion Period,
1. Make a qualified purchase of any Buildex, ZENITH, Ramset or Pryda product in one transaction from any Mitre 10, Home Timber & Hardware,
2. Thrifty-Link Hardware and True Value Hardware store or online.Visit the Promoter’s website: https://www.itwproline.com.au/deckthisout and fully complete the online entry form by providing all requested information.
To verify each entry entrants must retain:
1. The original purchase receipt(s). Proof of purchase is a strict condition / requirement of the competition.
2. Receipt or tax invoice accepted. Date of purchase must be clearly visible.
The Promoter may require entrants to provide these and/or information regarding the circumstances of product purchases to the Promoter or its agent as part of determining the winner of the prize. Failure to provide these to the Promoter’s satisfaction will result in an invalid entry (and, at the Promoter’s discretion, all of the entrant’s entries being invalid).
Entries may only be submitted online and in the correct form provided on the website and will not be accepted by the Promoter in any other form.
Entries must be received by the Promoter during the Promotion Period . The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence, whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over mobile telephone or internet communications, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
Multiple entries are permitted, however, only one (1) entry is permitted per qualifying transaction and entries must be submitted individually through the website https://www.itwproline.com.au/deckthisout /. If an entrant is unable to provide proof of purchase at the time of being awarded a prize, then all the entries of that entrant will be deemed invalid. Sharing receipt / invoice numbers is not allowed. If the Promoter reasonably believes that an entry has been made on this basis, the Promoter will invalidate all entries affected.

There will be three (3) minor prize draws (“Minor Prize Draw”) and one (1) major prize draw (“Major Prize Draw”). Entries close for each draw on the dates and times specified in the table below. Each Minor Prize Draw will take place at ITW Construction Asia Pacific, 47-55 Williamson Road, Ingleburn NSW 2565 and the Major Prize Draw will take place at Anisimoff Legal, G13, 3 Amy Close, Wyong NSW 2259 on the dates and times specified in the table below. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Prize winners will be notified by telephone and email within three (3) business days and all winners will have their names published on the Promoter’s website https://www.itwproline.com.au/deckthisout on the dates specified in the table below. Non-winning entries in each draw will be entered into any subsequent draws and all entries (including winners in a Minor Prize Draw) will be entered into the Major Prize Draw.

The first valid entry drawn from the Major Prize Draw will win $25,000 cash in the form of a direct bank deposit.
The next five (5) valid entries drawn will each win a Sony PlayStation® 5 Console & Samsung® 65″ CU8000 4K Crystal UHD Smart TV Combo Pack valued at $2294 each.
The next ten (10) valid entries drawn will each win a Weber® BBQ prize pack valued at up to $10001,0530 each.
A draw for any unclaimed prizes may take place on Thursday 25th January 2024, at the same time and place as the original draw, subject to any directions from a regulatory authority. If such a draw is required, the winner will be notified within 3 days via phone or email and have their first name and city announced on the Promoters website www.itwproline.com.au on a page link.
For all Prizes (excluding the $25,000 cash in the form of a direct bank transfer) the Promoter will organise the delivery of the prizes on behalf of the winner and arrange for the prizes to be sent to their nominated address as entered into the promotion.
Winner/s are responsible for ensuring that all prize delivery details provided are correct. The Promoter will not be liable for any costs associated with re-delivery of a prize, should the delivery details provided by a winner be incorrect.
Total prize pool value is $50,000.
If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification subject to the written directions of any regulatory authority. Winners will not be entitled to any additional compensation in the event that the prize or an element of a prize has been substituted at equal or greater value.
The total prize package, or parts of the prize are not transferable or exchangeable and cannot be taken as cash.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, weather, site issues, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant or winner; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia that are incapable of being excluded (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) use/taking of a prize.
All promotions are only valid for those residing in Mainland Australia (including Tasmania and other major Australian offshore islands). The Promoter reserves the right to withhold delivery if the stated delivery address falls outside of these locations.
